Do you always need a lawyer?

This answer from us may surprise you. Sometimes you don’t need a lawyer.

Say you have been involved in an accident which is not your fault. You have exchanged insurance details with the other driver. He contacts his own insurers who will almost immediately try to make contact with you. You have not suffered any kind of injury. The helpful insurance representative tells you he can arrange a courtesy car whilst your car is being replaced or repaired. He will have your car taken to his recommended garage. The whole process will be completely painless for you.

If you are hurt in any way, don’t get injured twice, get a lawyer. The insurers will pay their fees, you will not be out of pocket in any way, and you will get what you deserve.

They are contacting you for a reason, and they are playing nice with you for a reason. They know that they will end up as the paying party and they are anxious to minimise their outlays and exposure. They don’t want you racking up hire charges. They want to use their own garages where there is lots of repeat business and they can control costs. They want to draw a line under the claim as quickly as possible. This is what is known in the insurance industry as “Third Party Capture”. Don’t be in any doubt about matters, the captive is you.

If you haven’t suffered injury then there is a lot to be said for letting them at least control the provision of a courtesy car. You will see what is said elsewhere on this website about the standard of repairs carried out by insurers. You can tell them that you will be instructing repairs from an independent garage of your own choosing. Alternatively you can subject the repair work to a detailed inspection for quality and be prepared to insist it has to be been done right . In that situation you don’t need a lawyer.

It’s different if you have been injured in any way. Basically they want you to sign away your rights and they will make a bargain basement offer to you to achieve that end. If they can get you to sign a discharge that is case closed for them.
